Policyholders construction obligations after a loss
PAAC Group is aware that it is the policyholder’s responsibility to mitigate damages and to repair their building as per their contractual obligations under Statutory Condition 9.(1) Salvage. The insurance company is only responsible to pay the costs as per section 9.(2) of Salvage
Salvage
9. (1) The insured, in the event of any loss or damage to any property insured under the contract, shall take all reasonable steps to prevent further damage to such property so damaged and to prevent damage to other property insured hereunder including, if necessary, its removal to prevent damage or further damage thereto.
9. (2) The insurer shall contribute proportionately towards any reasonable and proper expenses in connection with steps taken by the insured and required under subcondition (1) of this condition according to the respective interests of the parties.
Statutory 6, Requirements After Loss, confirms that it is the policyholders responsibility to prove their claim by providing a detailed account of all damages to contents, stock, equipment, and building . Remember this is not the insurance companies responsibility.
Requirements After Loss
6. (1) Upon the occurrence of any loss of or damage to the insured property, the insured shall, if the loss or damage is covered by the contract, in addition to observing the requirements of conditions 9, 10 and 11,
6.(1)(b) deliver as soon as practicable to the insurer a proof of loss verified by a statutory declaration
6.(1)(b)(i) giving a complete inventory of the destroyed and damaged property and showing in detail quantities, costs, actual cash value and particulars of amount of loss claimed.
Our design – bid – build construction method
In the reconstruction phase we use the Design-Bid-Build (DBB) method to complete all construction work. We understand the importance of documenting the damages and ensuring that the scope of work clearly reflects the design and finishes that were in place at the time of the loss. We also understand that most policyholders, after sustaining significant damage to their home or business, would like to make changes to the original design and finishes.
Design-Bid-Build is a traditional construction project delivery method that helps us distinguish between the quantification of the old and new build design. Insurance companies will not pay for any upgrades or additions within the reconstruction phase. So, it is imperative to demonstrate what costs are loss related vs upgrades. The DBB process along with the supporting help of our adjusting and legal department make this a seamless transition for policyholders.
